By using V CAST Music (the “Service”), you acknowledge that you have read and agree to be bound by this V CAST Music License and Use Agreement (“Music Agreement”).
If you do not agree to (or cannot comply with) this Music Agreement, do not use the Service. You represent that you are either (i) the account holder for the mobile telephone number used to access the Service; or (ii) at least 13 years old and authorized by the account holder (and, if you are under 18, your parent or guardian [if they are not the account holder]) to use the Service.
V CAST Music phone required (not available on all V CAST phones). V CAST Coverage Area and airtime required to manage alerts and browse, preview, purchase, and download music on your phone. If you do not have an active V CAST VPak subscription, these activities will use airtime that will be deducted from your Voice Calling Plan’s monthly anytime minute allowance or charged at the applicable per-minute rate. A Postpay Digital Calling Plan, Windows® XP operating system and Windows Media® Player 10 are required to purchase music on your PC. Verizon Wireless is not responsible and assumes no liability for V CAST Music content, including, without limitation, any defamation, obscenity or profanity you may encounter through use of the Service. Verizon Wireless reserves the right to terminate service upon expiration of your Customer Agreement term. The Service is for individual use only and is not for resale. Phone will end data call and session after a minimum of 30 seconds of inactivity. Content providers, service functionality and menu order may change without notice. All music sales are final. All content offered through the Service (“Secure Content”) is protected by Windows Media® digital rights management technology (“WM-DRM”) so that the intellectual property rights, including copyright, of the content owners that have licensed Secure Content to the Service (“Secure Content Owners”) are not misappropriated. Your rights with respect to Secure Content are limited by copyright law and by the Usage Rules below. Your V CAST phone uses WM-DRM software to play Secure Content (“WM-DRM Software”). Use or distribution of WM-DRM Software outside of the Service is prohibited without a license from Microsoft or an authorized Microsoft subsidiary. If the security of the WM-DRM Software in your phone has been compromised, Secure Content Owners may request of Microsoft, and Microsoft may require of Verizon Wireless, to revoke the WM-DRM Software’s ability to acquire new licenses to copy, display and/or play Secure Content without notice. Revocation does not alter the WM-DRM Software’s ability to play unprotected content. A list of revoked WM-DRM Software is sent to your phone whenever you download a license for Secure Content. Microsoft may, in conjunction with such license, also download revocation lists onto your phone on behalf of Secure Content Owners. The following Usage Rules are licensing rules assigned by Verizon Wireless and/or Secure Content Owners that limit your access to and use of Secure Content. These rules govern your rights with respect to Secure Content you have purchased, regardless of whether unauthorized rules have been associated with the Secure Content by another party. You may: (i) play back Secure Content an unlimited number of times; (ii) burn Secure Content to compact disc (CD) five (5) times per song; and (iii) use a compatible USB cable to synchronize (“sync”) Secure Content stored on your PC to three (3) portable digital media players that support WM-DRM, including your V CAST phone (“Authorized Portable Device”). Secure Content that you have synced to an Authorized Portable Device cannot be further transferred to other devices for playback. Verizon Wireless may modify these Usage Rules without notice to you, and may enforce these rules (for itself and for Secure Content Owners) without notice to you. In addition to this Music Agreement, you agree to abide by all rules and policies regarding the Service established from time to time by Verizon Wireless, including required or automated updates, modifications, and/or reinstallations of the software and obtaining available patches to address security, interoperability, and/or performance issues. You also agree: (i) to comply with all applicable laws in your use of Secure Content; (ii) not to reverse-engineer, decompile, disassemble, or otherwise tamper with or modify any of the security features, Usage Rules or other components of the Service for any reason (or aid anyone else in doing so); (iii) to use all Secure Content solely for your own personal, noncommercial entertainment and not for resale or redistribution of any kind, and (iv) to use Secure Content solely in accordance with the Usage Rules. Verizon Wireless may remove Secure Content from the Service or change the charges applicable to Secure Content without prior notice. Charges displayed on the Service for Secure Content do not include applicable taxes, which will be billed in addition to Secure Content charges on your Verizon Wireless bill. Upon termination of service, you will lose any Secure Content purchased but not yet downloaded.

V CAST cannot be used: (i) for access to the Internet, intranets or other data networks except as permitted via Get It Now; (ii) for any applications that tether your phone to laptops, personal computers or other devices for any purpose; (iii) for uploading, downloading or streaming of movies, music or games unless offered through Get It Now; (iv) for sustained, high-bandwidth applications, including, without limitation, Web camera posts or broadcasts, automatic data feeds, Voice over IP (VoIP), or peer-to-peer (P2P) file sharing; and/or (v) as a substitute or backup for private lines or dedicated data connections. We reserve the right to limit throughput or amount of data transferred, and to deny or terminate data services, without notice, to anyone we believe is using V CAST in any prohibited manner, whose usage adversely impacts our network or service levels, or whose usage exceeds reasonable levels.
