VZAppZone allows you to access, download, install, and use business and consumer applications and content, including news and weather, support and maintenance, software and device updates and upgrades, guides and tutorials, productivity tools or other information (collectively, “Applications”), directly to a compatible advanced wireless device. Data usage for browsing, downloading and using Applications will be billed on a per-kilobyte basis: (i) whenever you are roaming in the Canadian Broadband Area, Canadian Enhanced Services Rate and Coverage Area or Mexican Enhanced Services Rate and Coverage Area; or (ii) if you are roaming in the Extended National Enhanced Services Rate and Coverage Area and you subscribe to a usage-based data plan or feature or use data on a pay-as-you-use basis. You will be notified of applicable recurring or nonrecurring surcharges such as transaction charges, one-time fees, monthly fees or other subscription charges when purchasing Applications. You will be responsible for all charges incurred until the Application is deleted from your account, even if you lose or replace your wireless device. You agree: (1) to use Applications only on the wireless device to which they are downloaded, even if downloaded pursuant to an unlimited or other long-term agreement, and no transfers, credits or refunds are permitted; (2) not to (i) harass, offend, threaten, embarrass, distress or invade the privacy of any individual or entity; (ii) provide false information or impersonate another person; and/or (iii) take any action that infringes upon any third party’s copyright, trademark, patent or other intellectual property rights(s); and (3) to be bound by the VZAppZone License Agreement between you and each Application developer.
